Who we are

GainAI ("we", "us") operates the GainAI service at gainai.me and is responsible for the personal data described in this policy. Contact: support@gainai.me.

What we collect

• Account data: your email address and sign-in details (including data provided by Google if you sign in with Google).
• Content you provide: chats, voice recordings and their transcripts, images, website addresses, business details, budgets and instructions you give the agent.
• Advertising data: if you connect Meta, an access token and the IDs and names of the ad account, Facebook Page and Instagram profile you choose, plus campaign settings and performance statistics.
• Payment data: top-up and subscription amounts and status. Card details are processed by our payment provider; we do not store full card numbers.
• Technical data: IP address, browser and device information, logs and error reports needed to keep the service secure and working.

Why we use it

• To provide the service you request: analyzing your product, preparing strategy, copy and images, and creating, launching, pausing and measuring campaigns (performance of our contract with you).
• To process payments, keep records and meet legal, tax and accounting obligations (legal obligation).
• To keep the service secure, prevent fraud and abuse, and fix errors (our legitimate interests).
• To send service messages about your account, payments and campaigns. We send marketing messages only with your consent, and you can unsubscribe at any time.
• We do not use your data for automated decisions that have legal or similarly significant effects on you. The AI agent only acts on your instructions.

Meta data

Meta access tokens are stored encrypted on our servers and never sent to the browser. We use Meta data only to manage your own ads and do not sell it or share it for other purposes. You can remove GainAI at any time in Facebook Settings → Business Integrations.

Who we share it with

• We do not sell personal data.
• We share data only with providers that help us run the service – hosting and database, AI model providers, speech recognition, payment processing and advertising platforms such as Meta – and only as needed to provide the service. They are bound by confidentiality and data-protection obligations.
• We may disclose data if required by law, to protect our rights, or in connection with a merger or sale of the business.

International transfers

Our providers may process data outside your country. Where this happens, we rely on appropriate safeguards such as standard contractual clauses or equivalent protections.

How long we keep it

We keep account and project data while your account is active. Deleting a project deletes its chat history. After account deletion we remove or anonymize your data within 30 days, except records we must keep for legal, tax or dispute purposes, which are kept only as long as required.

Your rights

• You can ask to access, correct, delete or export your data, restrict or object to its processing, and withdraw consent at any time (without affecting earlier processing).
• To use these rights, email support@gainai.me. We reply within one month. You also have the right to complain to your local data protection authority.

Security

We use encryption, access controls and other reasonable measures to protect your data. No system is fully secure, so we cannot guarantee absolute security.

Children

GainAI is not intended for anyone under 18, and we do not knowingly collect their data.

Cookies and storage

We use only essential cookies and browser storage needed for sign-in, security and your settings (such as the theme). We do not use advertising cookies on this site.

Changes

We may update this policy. We will show the new date here and, for significant changes, notify you in the app or by email.

Agreement

By creating an account or using GainAI you accept these Terms. If you do not agree, do not use the service. You must be at least 18 and able to enter a binding contract. If you use GainAI for a business, you confirm you are authorized to bind it.

How GainAI works

• You describe your product, goal and budget by text or voice. The AI agent analyzes your website, proposes a strategy and prepares ads: audiences, copy and images.
• Before anything that spends money, the agent asks for your approval. You can review, edit or reject each ad, or choose to approve without a detailed review.
• Ads run either in your own Meta ad account or, if you choose, from the GainAI page using your GainAI ad budget. After launch the agent monitors results and may pause weak ads and shift budget between ads within the limits you approved. It never raises your budget without your approval.

Your responsibility for ads

• The agent is a tool that acts on your instructions. You are the advertiser and are solely responsible for every ad launched through your account – its content, claims, images, targeting, landing page and the products or services advertised – and for complying with all laws and advertising platform rules.
• AI-generated content may be inaccurate, incomplete or unsuitable. You must check it before approval. If you choose to approve without reviewing, or let the agent act on your behalf, you do so entirely at your own risk.
• You confirm you have all rights to the materials, brands and websites you provide, and that your ads will not infringe anyone's rights or mislead anyone.

Prohibited use

You may not use GainAI to advertise illegal, counterfeit, dangerous, deceptive, hateful or adult content, or anything prohibited by Meta or other platform rules, or to misuse, reverse engineer or overload the service. We may refuse, pause or remove any ad or campaign and suspend or close accounts at our discretion, with or without notice.

Advertising platforms

Ad delivery, review, rejection, pricing and account restrictions are controlled by Meta and other platforms, not by us. We are not responsible for their decisions, outages, policy changes, account bans or charges.

Payments

• You pay for use of the AI agent according to the prices shown in the app. We take 0% commission on your ad budget.
• When ads run from the GainAI page, the full campaign budget is reserved and charged at launch. Once a campaign has launched, its budget is fixed and cannot be refunded, increased or decreased.
• Except where required by law, all payments are final and non-refundable. Prices may change with notice for future purchases.

No guarantee of results

We do not guarantee any impressions, clicks, leads, sales, return on ad spend or other results. Advertising involves risk, and you may spend your budget without getting the results you want.

Service provided "as is"

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy or uninterrupted operation. We may change, suspend or discontinue any part of the service at any time.

Limitation of liability

• To the maximum extent permitted by law, GainAI is not liable for any indirect, incidental, special or consequential damages, lost profits, lost revenue, lost data, wasted ad spend, or damages arising from ads you approved or allowed the agent to run, platform decisions or third-party services.
• Our total liability for any claim is limited to the amount you paid us for use of the AI agent in the 3 months before the claim, excluding ad budget. Nothing in these Terms limits liability that cannot be limited by law.

Indemnity

You agree to compensate and defend GainAI against any claims, fines, losses and costs arising from your ads, your content, your use of the service or your breach of these Terms or of any law or platform rule.

Your content

You keep ownership of the content you provide. You give us a licence to use it to operate the service. Subject to these Terms and third-party rights, you may use the ads generated for you.

Ending use

You can stop using GainAI and request account deletion at any time. Campaigns already launched and paid for are not refunded. Sections that by their nature should survive (responsibility, payments, liability, indemnity) remain in effect.

Changes

We may update these Terms. Continued use after the new date means you accept them.
